Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Distribit ("Service"), operated by Fantastic Online Stores PTY LTD (ABN 39 655 964 784), a company registered in Victoria, Australia ("Company", "we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Distribit is a distribution habit tracker designed for indie hackers and builders. The Service provides activity rings, streak tracking, daily target setting, weekly consistency monitoring, compounding projections, and shareable streak cards. The Service is delivered as a progressive web application (PWA).

3. Account Registration

To use certain features, you must create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You agree to provide accurate, current, and complete information and to update it as necessary.

3A. Eligibility

You must be at least 16 years old to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Products, Channels, and Action Logging

You may create products, channels, daily targets, and log distribution actions within the Service. All data you enter remains yours. We do not claim ownership of your content. You grant us a limited license to store, process, and display your data solely to provide the Service.

Action logs, streak data, and ring progress are calculated based on data you provide. We do not guarantee the accuracy of projections or compounding estimates, which are for motivational purposes only.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service
• Use automated means to access the Service except through our provided interfaces
• Misrepresent your identity or affiliation

6. Subscription Plans and Billing

Distribit offers Free, Pro ($9/month), and Premium ($19/month) plans. Paid plans are billed monthly via Stripe. You may cancel at any time from your settings page. Cancellation takes effect at the end of the current billing period. No prorated refunds are issued for partial months. When your subscription ends, your account reverts to the Free plan and the downgrade policy in Section 7 applies.

We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified before any price change takes effect.

7. Free Plan Limitations

The Free plan includes 1 product, 1 channel per product, and 7 days of history retention. Upgrading to a paid plan increases these limits. If you downgrade from a paid plan, all your existing data is preserved. However, only your most recently active product (determined by last action logged) will remain fully usable. Additional products beyond your plan limit become read-only: you can view their data but cannot log actions, edit details, or change targets until you upgrade again.

8. Intellectual Property

The Service, including its design, code, rings mechanic, and branding, is owned by Fantastic Online Stores PTY LTD. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written consent.

You retain ownership of content you create within the Service (product names, descriptions, action logs). By using shareable streak cards, you grant us a limited license to display your streak data in the generated image.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Third-Party Services

The Service integrates with the following third-party providers:

• Supabase (authentication, database)
• Stripe (payment processing)
• Vercel (hosting, edge functions)
• PostHog (product analytics)
• Resend (transactional email)

Each provider operates under its own terms and privacy policy. We are not responsible for third-party services.

11. Termination

You may close your account at any time. We may suspend or terminate your access with 30 days' notice, or immediately if you materially breach these Terms. Upon termination, your right to use the Service ceases. We may retain anonymized, aggregated data for analytics purposes.

12. Indemnification

You agree to indemnify and hold harmless Fantastic Online Stores PTY LTD, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. STREAK DATA, COMPOUNDING PROJECTIONS, AND RING PROGRESS ARE FOR MOTIVATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE PROFESSIONAL ADVICE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of Victoria, Australia, without regard to conflict of law principles. Any disputes shall first be resolved through good-faith negotiation. If unresolved after 30 days, disputes shall be submitted to binding arbitration in Melbourne, Australia.

16. Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions or class-wide arbitration, except where prohibited by applicable law (including for residents of the EEA, UK, or Australia where local consumer protection laws apply).

17. Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, government actions, internet outages, or third-party service failures.

18. General Provisions

These Terms constitute the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a right does not constitute a waiver. You may not assign your rights under these Terms without our consent.

19. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated with at least 30 days' notice via email or in-app notification. Continued use after the effective date constitutes acceptance.
